Terms and Conditions Governing the Sale and Purchase of Yogi Tea Products within the EU, the use of the Yogi Tea Website and Returns
Set out below are the terms and conditions (the “Terms “) under which users of the Yogi Tea website http://www.yogi-life.com (the “Website”) (a) are granted access to and use of the Website and (b) may purchase Yogi Tea products listed for sale from time to time on the Website (“Products”). No other terms and conditions supplied or referred to by you relating to use of the Website or the purchase of Products shall apply.
Use of the Website or the placing of an order for the purchase of Products constitutes your legally binding agreement to be bound by the Terms. If you do not accept the Terms, please discontinue and refrain from the use of the Website.
The Terms may be amended by us at any time and from time to time in which case the amended Terms will be posted on the Website. Use of the Website following the amendment of the Terms constitutes your acceptance of the amended Terms and your agreement to be legally bound by the amended Terms.
1. Information Concerning Yogi Tea
The Website is owned and operated by YOGI TEA GmbH (“Yogi Tea”), which is a company incorporated in Hamburg under registration number HRB 94492 having its principal place of business at Burchardstraße 24 20095 Hamburg References in the Terms to “Yogi Tea”, “we” or “us“ mean Yogi Tea GmbH.
2. The Submission of Orders, Acceptance Confirmation and Contract Formation
2.1 The submission by you of an order constitutes an offer by you to us to purchase Product(s). Such an order is subject to our acceptance and subject to the Product(s) being available. If we are in a position to accept your order, we will communicate acceptance to you by the issue of an e-mail to the e-mail address furnished to us (“Acceptance Confirmation”). The issue of an Acceptance Confirmation creates a legally binding contract for the sale and purchase of the Product (the “Contract”). In the event that we are not in a position to issue an Acceptance Confirmation in respect of all of the Product(s) referred to in your order we shall issue an Acceptance Confirmation only in relation to the Products which we are in a position to sell to you. No obligation shall apply in relation to Products ordered by you which are not the subject of an Acceptance Confirmation.
2.2 No person who is under the age of 18 years may use or enter into a contract with us.
3. Use of the Website
3.1 Use of the Website is exclusively for the purpose of placing orders for the purchase of Products for non-commercial purposes. No one is permitted to copy, reproduce, publish download, broadcast, transmit or make available to the public, or incorporate into any derivative work the whole or any part of the Website.
3.2 You may not use the Website for any unlawful purpose.
3.3 While we have taken reasonable care to ensure the accuracy of the information, names, images, pictures, logos, and graphics relating to Yogi Tea and the Products and services including third party products and services such are provided for information purposes and without liability to us. Images and photographs of the Products may not necessarily accord with the actual size, shape and colour of the Products.
3.4 Other than as set out in the Terms no other terms, conditions, warranties, representations, express or implied, shall apply to the use of the Website or to the sale of Products other than those applicable to a contract for the sale of goods to a consumer under applicable law.
3.5 We provide no assurance that the use of the Website will be uninterrupted or error free or free from bugs, viruses and other similar defects. We may, without prior notice, suspend, withdraw or restrict the availability of all or any part of our Website for business and operational reasons.
4. Intellectual Property Rights
4.1 The contents of the Website and all images referred to on the Website together with, names photographs, logos referring to Yogi Tea constitute the intellectual property of Yogi Tea and all copyright, trademarks, service marks, and design rights therein are owned by Yogi Tea. Use of the Website and or the purchase of Products shall not confer any right or license to use the intellectual property of Yogi Tea or the intellectual property of any third party whose photographs, logos or intellectual property rights are referred to on the Website.
4.2 In the event that you submit information to us (“User Contribution”), you shall be deemed to have accepted the following additional terms:
a) that you are the sole author and owner of the intellectual property rights in the User Contribution;
b) that you are legally entitled to submit the User Contribution to us;
c) that the User Contribution does not infringe any third-party rights and is not defamatory of any person;
d) that the User Contribution is true and accurate in all respects;
e) that you hereby grant Yogi Tea a non-exclusive right and license to use the User Contribution for the purposes of its business in such manner as reasonably determined by Yogi Tea; and
f) that you will indemnify Yogi Tea for any loss and damages incurred as a result of any breach by you of the foregoing obligations.
5. Third Party Content and Links
5.1 Where the Website contains links to other websites and resources provided by third parties, such links are provided for your information purposes only. Such links should not be interpreted as approval or endorsement by us of those websites or information.
6. Your Right to Cancel the Contract
6.1 Under applicable law governing distance contracts with consumers, you are entitled to cancel your contract with us within 14 days commencing on the date on which the Product(s) was delivered to you. You may exercise the cancellation right for any reason.
6.2 The right of cancellation does not apply to Products that are clearly personalized (that is made to your specific order) or constitute perishable Products, being those that are liable to deteriorate or expire rapidly such as those Products sold in a “reduced price sale” context where the price has been reduced due to a short shelf life/short best before date. Save for such exceptional circumstances, Yogi Tea Products do not ordinarily constitute perishable Products. However, in such exceptional circumstances, you may be able to cancel the contract and or obtain a refund if the Products are defective, do not correspond to the description or where we are in breach of warranty, see paragraph 7 below.
6.3 If you wish to exercise the right of cancellation as described in this paragraph 6, you should use the prescribed cancellation form set out below or send us an unequivocal statement by e-mail, communicating your decision to cancel the contract. The cancellation form and or your e-mail communication should be sent to us at [email protected].

6.5 Following cancellation you must return the Product(s) to us at the following address:

Not later than 14 days following the date on which the contract was cancelled. Pending the return, you are required to take reasonable care of the Product(s).
The cost of posting the Product(s) to us is to be discharged by you and all risk associated with the return of the Product(s) should be borne by you until they are received by us.
6.6 Once we have received the returned Product(s), we will reimburse you for all payments received by us from you in respect of the returned Product(s).
6.7 We will reimburse you within the earlier of 14 days of the date when we receive the Product(s) from you or the receipt of evidence of your having sent the Product(s) back to us.
6.8 We are entitled to deduct from the amount we reimburse you the following:
a) any diminished value of the Product caused by your failure to take reasonable care of the Product prior to its return or if it is caused by unnecessary handling of the Product beyond that necessary to establish the nature, characteristics and functionality of the Product.
b) any diminished value of the Product where it has been consumed or tampered with or opened unless the Product is defective or otherwise does not correspond with the description, for which see paragraph 7 below.
c) any diminished value of the Product attributable to damage caused by your failure to properly package the Product for its return to us.
7. Warranties
7.1 Under applicable law governing contracts with consumers, we are required to ensure that the Product(s) delivered to you, under our “Contract” with you:
a) shall correspond with the description and shall be of the type, quantity and quality as specified in the Contract;
b) shall be fit for all of the purposes for which Product(s) of the same type would normally be used; and
c) shall be of the quantity and possess the qualities and other features normal for Product(s) of the same type that the purchaser may reasonably expect given the nature of the Product(s) and taking into account any public statement in relation to the Product(s) made by or on behalf of Yogi Tea.
7.2 Subject to applicable law, we hereby exclude from our Contract with you all other warranties, terms and conditions, express or implied.
7.3 Subject to applicable law, in no event shall the total financial liability of Yogi Tea for the use of the Website or under any Contract exceed the amount paid by you and/or the purchase price of the Product(s).
7.4 Subject to applicable law, Yogi Tea shall not be liable under the Contract or under any other principle of law for any indirect, special or consequential damages, including loss of profits, business interruption, or the rising out of the use of the Website and/or the purchase of Products.
7.5 Nothing in these Terms shall limit our liability for death or personal injury, fraud caused by the negligence, breach of Contract or breach of duty by Yogi Tea or for any liability which may not be excluded under applicable law.
7.6 In the event that the Product(s) do not satisfy the requirements in paragraph 7.1 above, you may cancel the Contract and obtain a full refund provided that you notify us of the cancellation within 12 months of the date of delivery of the Product(s). The provisions of paragraph 6 shall apply. When returning the Product(s) you must indicate the grounds upon which you consider that the Product(s) does not conform to the requirements of paragraph 7.1.
8. Risk and Title in the Product(s)
Risk in the Product shall be passed to you at the time of delivery. Ownership of the Product(s) shall pass to you when we receive full payment for the Product(s).
9. Import Duties and Customs Charges
If you are located outside of Germany or France, the importation of the Product(s) into your location may be subject to import duties, customs charges and similar import taxes imposed by the Revenue and Customs authorities of the place of your location. Yogi Tea is not liable to discharge such import duties, customs charges and similar import taxes. Such constitutes your liability, and in the event that they are not discharged Yogi Tea shall not be liable in respect of any consequences arising from the actions of the Revenue and Customs authorities in the place of your location.
10. Governing Law and Jurisdiction
Use of the Website and Contracts for the purchase of Products shall be governed by + the laws of Germany. Any dispute or question of interpretation relating to the Website or Contracts for the purchase of Products shall be subject to the jurisdiction of the Courts of Germany.
11. Payment
11.1 The price of our Products is inclusive of VAT.
11.2 While we make every effort to ensure pricing accuracy, occasional errors may occur. If, at the time you place your order, the correct price of a Product is lower than the price advertised, you will be charged the lower amount. Where the correct price is higher than the advertised price, we will contact you before processing the order to ascertain whether you wish to proceed. In the event that a pricing error is obvious and could reasonably have been recognized as such, we reserve the right to cancel the Contract, refund any payments made, and request the return of any Products already delivered.
11.3 We accept payment with all major credit and debit cards, together with PayPal, Apple Pay and Google Pay.
11.4 Payment will be deducted in full at the point that we accept your order by issue of an Acceptance Confirmation.
12. Shipping
12.1 We currently ship to the following countries: Germany and France. If your location is not listed, please contact us at [email protected] to inquire about alternative purchase options.
12.2 All accepted orders are processed within 2-4 business days in Germany and 2-8 business days to France after receiving payment. Orders are not shipped or delivered on weekends or public holidays. During high volume periods (e.g., public holidays or promotions), processing may be delayed. We appreciate your patience and understanding.
12.3 We offer the following shipping options: 4,99 € for Germany and 5,99 € for France. Note: Delivery times are estimates and may vary depending on destination, customs processing, and carrier delays.
12.4 Shipping charges for your order will be calculated and displayed at checkout. Free shipping is available on orders over 39,00 €.
12.5 Once your Product has been shipped, you will receive a confirmation email with a tracking number. You can use this number to track your package via the carrier’s website.
13. Delivery
13.1 Delivery charges are clearly outlined on the Website and can be reviewed by referring to our Delivery Schedule.
13.2 During the checkout process, you will be informed of the expected delivery timeframe. For items currently in stock, we aim to dispatch and deliver them as soon as possible, in line with the estimated delivery timeframes.
13.3 Should there be a delay due to circumstances beyond our control, we will notify you as soon as possible and take reasonable steps to minimize any disruption.
13.4 If the delivery cannot be made at your address and the products cannot be posted through your letterbox, the courier will provide instructions on how to re-arrange delivery.
14. Privacy

15. Applicable Law
References in these Terms to applicable law include EU Directive 2019/771 of 20 May 2019 on certain aspects concerning contracts for the sale of goods, amending EU Regulation 2017/2394 and EU Directive 2009/22/EC and repealing EU Directive 1999/44/EC and EU Directive 93/13 as transposed in the jurisdiction referred to in paragraph 10 and as amended from time to time.
16. Product Recalls
In exceptional circumstances, it may be necessary for us to recall Products on health and safety grounds or where we reasonably suspect that the Products fall below the Yogi Tea quality standard. In such circumstances, we will notify you concerning the matter and will make arrangements for the return of delivered/ordered Products and issue of full refunds.
17. Geo Location Data
Yogi Tea uses software to assist us in the identification of your location. Such information (known as location data/geolocation data) constitutes personal data within the meaning of GDPR (EU Regulation 2016/679). Such information is used by us in accordance with our Privacy Policy. By your use of the Website and/or placing an order with us, you shall be deemed to consent to our use of such data.
